如果没有得到监护令，父母双方对孩子有平等的权利。父母双方都有权为孩子做决定，任何一方都可以在任何时候陪伴孩子。在法院下达命令之前，父母双方对对孩子的权利是平等的，除非各州另有规定。

法定监护和人身监护是法院用于描述法院可以授予父母一方或双方不同监护类型的法律术语。

法定监护权是对儿童作出重要决定的权利，如医疗和教育决策。共同法定监护权是指父母双方都有这种权利。唯一法定监护权是指父母中只有一方拥有这种权利。

人身监护权是指孩子和谁生活在一起，谁有权利照顾孩子的日常需要。人身监护权可以分为几种类型。共享人身监护权是指孩子有两个家，一部分时间和父母一方生活，另一部分时间和父母另一方生活。主要人身监护权是指法院仅授予父母一方在大部分时间里让孩子与他/她生活在一起的权利。

如果父母一方拥有主要监护权，法院可以给予另一方部分人身监护权或探视权。如果父母一方拥有主要监护权，法院可以给予另一方部分的人身监护权或探视权。探视是指父母没有任何形式的人身监护权，但有权花时间陪伴孩子。
